Designer Handbag Consignment — Terms & Conditions

These Terms & Conditions apply when you provide a designer handbag or other luxury item to Authentic8 (“we”, “us”, “our”) for authentication and potential sale on your behalf.

By sending or delivering an item to us, you confirm that you have read and agreed to these Terms & Conditions.


1. Ownership of Items

You confirm that:

  • You are the legal owner of the item, or you have the full authority and permission from the legal owner to consign the item for sale.
  • The item is not stolen, subject to finance, a lien, dispute, or any third-party claim.
  • You have provided us with accurate information about the item's ownership, history, condition and authenticity.
  • You will notify us immediately if your ownership or authority to sell the item changes.

We reserve the right to request proof of ownership or other information before accepting an item.

 

2. Sending Items to Us

Items may be sent to us by post/courier or delivered by an agreed method.

You are responsible for ensuring that the item is appropriately packaged and insured while it is being sent to us. We are not responsible for loss or damage occurring before the item is received by us.

Where appropriate, we may provide instructions regarding packaging and delivery.


3. Authentication

Items will not be listed for sale until they have been authenticated to our satisfaction.

Authentication may be carried out by us or by an appropriate third-party authentication service.

Authentication does not constitute an absolute guarantee that an item is genuine. Where an item cannot be satisfactorily authenticated, we reserve the right not to list it for sale.

If an item is suspected of being counterfeit or its authenticity cannot reasonably be established, we may refuse the item and arrange its return to you.

We reserve the right to retain information, photographs or records relating to suspected counterfeit items where reasonably necessary for legal, insurance, platform or other legitimate purposes.

 

4. Condition and Description

Before listing an item, we may photograph and inspect it and record its condition.

We will make reasonable efforts to accurately describe the item's condition, including any noticeable signs of wear, damage, alterations, repairs, missing accessories or other defects.

You must disclose any known damage, repairs, alterations, replacement parts or other relevant information.

We are not responsible for defects or issues that were not disclosed to us and could not reasonably have been identified during our inspection.


5. Pricing and Offers

The selling price of each item will be discussed and agreed with you.

We may receive offers from potential buyers. Offers, discounts or changes to the asking price will be discussed with you where appropriate before being accepted.

We do not guarantee that an item will sell for its original asking price or within any particular period.

Prices may be reviewed from time to time to reflect market conditions, demand and comparable items.


6. Listing and Marketing

Once an item has passed our authentication process, we may list and advertise it through our chosen sales channels.

This may include our website, social media accounts, online marketplaces and other appropriate sales platforms.

We may photograph, describe and promote the item for the purpose of selling it.

You authorise us to use photographs and descriptions of the item for marketing and sales purposes while the item is consigned to us.


7. Consignment Period

The standard consignment period is 30 days from the date the item is listed for sale, unless otherwise agreed with you in writing.

We do not guarantee that an item will sell during this period.

If the item has not sold at the end of the 30-day period, we will contact you to discuss whether:

  • the item should be returned to you;
  • the item should remain listed for an additional agreed period; or
  • another arrangement should be made.

If you request the item to be returned, you will be responsible for the cost of postage/return delivery, unless otherwise agreed.


8. Return of Unsold Items

Where an item has not sold and you request its return, we will arrange its return using an appropriate delivery service.

You are responsible for the return postage costs.

We may require payment of the return postage cost before the item is dispatched.

You are responsible for providing an accurate delivery address and ensuring someone is available to receive the item.


9. Sale of an Item

Once an item is sold and payment has been successfully received from the buyer, we will deduct our agreed commission, fees and any other agreed costs before paying you the remaining balance. Payment processing fees are set at 3.5%.

The applicable commission or fee will be agreed with you before the item is listed.

Any applicable taxes or charges will be dealt with in accordance with applicable law.


10. Payment to the Seller

Payment will be made to the bank account or other payment method you have provided.

Payment will normally be made within [X] working days after the buyer's payment has cleared and the transaction is considered complete.

We may delay payment where there is a genuine dispute, suspected fraud, chargeback, authenticity concern, return request or other circumstance affecting the transaction.


11. Buyer Returns and Disputes

Where a buyer has a legal right to return an item, or where a legitimate dispute arises regarding an item, we may need to accept the return and/or refund the buyer in accordance with applicable law and the terms of the relevant sales platform.

If a buyer raises a genuine authenticity or condition dispute, we may investigate the matter and request additional information from you.

You agree to reasonably cooperate with us in dealing with such disputes.


12. Counterfeit or Suspected Counterfeit Items

You must not knowingly provide us with counterfeit, replica or unauthorised goods.

If we believe an item may be counterfeit or cannot be satisfactorily authenticated, we may refuse to list or sell it.

Where necessary, we may provide relevant information to the appropriate platform, authentication service, insurer, authorities or other relevant party.

You may be responsible for reasonable costs incurred as a result of an item being counterfeit where this is permitted by law.


13. Care and Storage

While an item is in our possession, we will take reasonable care of it and store it securely.

Items may be stored at our business premises/home-based premises.

You acknowledge that normal handling, inspection, photography and packaging may be necessary for the purpose of authentication and sale.


14. Loss or Damage

We will take reasonable care of items while they are in our possession.

Our liability for loss or damage will be subject to applicable law and the circumstances of the loss or damage.

You must provide us with an accurate description and reasonable indication of the item's value when requested.

We may maintain appropriate insurance for items held by us, but you should not assume that an item is insured for its full value unless we have expressly confirmed this.


15. Information Required From Sellers

We may request:

  • Full name and contact details;
  • Proof of identity;
  • Proof of address;
  • Bank/payment details;
  • Proof of purchase or ownership;
  • Original receipts, authenticity cards, certificates, dust bags or other accessories;
  • Information about the item's history and condition.

We may refuse to accept an item if sufficient information is not provided.


16. Personal Information

We will collect and use your personal information for purposes including managing your consignment, communicating with you, processing payments, complying with legal obligations and preventing fraud.

Personal information will be handled in accordance with our Privacy Policy.


17. Cancellation by the Seller

You may request the return of an item before it sells.

If an item has already been sold, dispatched or is subject to a pending transaction, cancellation may not be possible.

You may be responsible for reasonable costs already incurred in connection with the item, where applicable and permitted by law.

18. Failure to Collect or Accept Delivery

If an item is returned to you but you fail to accept delivery, or if you provide an incorrect address, you may be responsible for additional postage, storage or re-delivery costs.

19. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to your consignment will normally be the version in effect when you agree to consign the item, unless a change is required by law.

20. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.

Subject to applicable law, we will not be responsible for losses that arise from circumstances outside our reasonable control.

Nothing in these Terms & Conditions affects your statutory rights.

21. Events Outside Our Control

We will not be responsible for delay or failure to perform our obligations where this is caused by circumstances outside our reasonable control, including postal or courier failures, platform outages, cyber incidents, natural disasters, government action or other unforeseen events.

22. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be dealt with in accordance with the applicable laws and courts of England and Wales.

23. Seller Agreement

By sending or delivering an item to Authentic8, you confirm that:

  • You have read and understood these Terms & Conditions.
  • You agree to the authentication and consignment process.
  • You confirm that you have the legal right to sell the item.
  • You agree to the applicable commission and fees communicated to you.
  • You understand that sale is not guaranteed.
  • You understand that unsold items may be returned to you at your expense.
  • You have provided accurate information about the item.
